A Luverne man was indicted by a Crenshaw County grand jury in last month’s grand jury session for theft by deception.

Derek Stephen White of Luverne was indicted Feb. 10.

White, owner of All Seasons Construction in Luverne, has criminal cases in at least seven jurisdictions, according to Assistant Distract Attorney Levi Nichols. Cases cross state lines into Florida as well.

White was arrested in Pike County Dec. 28 for two accounts of theft of property first degree. He was released on a $5,000 bond the same day.

Victims of Derek and Nicole White have formed a Facebook page to join forces and seek retribution. These victims’ claim to be out approximately $400,000.

Brooks Sanderson said he hired Bama Barns and Roofing, owned by White’s wife, Nicole, to build a barn for him in Chumuckla, Fla.

Sanderson paid the couple $5000 for material to start on the barn.

After months of ignored phone calls and deleting his comments for reimbursement on their Facebook page, he still does not have his barn or his deposit.

Sanderson has filed a police report against the couple, but he said he is not holding out hope of seeing his money returned.

Nicole White, also known as Cynthia Nicole Caplinger and Cynthia McLoud Caplinger, was arrested in Autauga County in Jan. of this year for theft of property in the first degree.  The warrant states Nicole knowingly obtained $6,500 by deception with intent to deprive by receiving a down payment and then failed to complete the agreement for a construction project. She is currently out on bail.

Joe Nawlin said he hired Bama Barns in March of 2020 to build a pole barn on his property in Pike County. Nawlin alleges the couple came out to his property and obtained a check for $10,000 for the material for the barn. Nawlin alleges that Derek then requested additional money in the amount of $4,000 for concrete work to be done by another company.

Nawlin said after receiving both checks, the couple would not answer his phone calls. Derek did contact Nawlin after several weeks. Nawlin said he was told the delay on his barn was due to COVID or no available workers and set a new date to complete the project. Nawlin said he has not received any materials or work for the $14,000 paid. Charges have been filed in Pike County by Nawlin.

Bradley Mosley of Prattville said he gave the couple a check for $6,500 for materials after writing a contract with Bama Barns and Roofing to build a pole barn in May 2020.

“All I got was excuse after excuse,” Moseley said.

Moseley pressed charges on the couple in Jan. in Autauga County.

All Season’s Construction and Bama Barns and Roofing have multiple complaints with the Better Business Bureau; they are not accredited by the BBB. The complaints are all similar in nature, claiming payment was paid for services never provided. The complaints also mirror Sanderson’s claims of dodged phone calls and unreturned messages.
