The Alabama Board of Pardons and Paroles denied the parole petition to two m serving time for crimes in Butler County.

On Oct. 31, the board voted to deny parole to Rico Demond Boggan. He is currently housed in the Frank Lee Youth Center serving ten years for a possession/receiving a controlled substance – Class D conviction handed down on Sept. 7, 2023.

Prior to his current prison term, Boggan served two years for charges stemming from March 2020 sentences — ten years for distributing a controlled substance and two years for possession/receiving a controlled substance, Class D concurrently with an eight-year sentence for possession/receiving a controlled substance, Class D.

Boggan’s connection with drug-related crimes in Butler County stems back to 2004, when he served one year and five months for three first-degree counts for possession of marijuana. In 2006, Boggan was convicted on two more first-degree possession of marijuana charges and served two and a half years of two concurrent five-year sentences.

A pair of two-year sentences were added to Boggan’s record in 2017 — one count of Class D possession/receiving of a controlled substance and one count of distributing a controlled substance. He served just under two years for these sentences.

The board heard 21 parole petitions on Oct. 31, granting six and denying 15. The board also held 10 pardon hearings, granting seven and denying three.

On Nov. 6, the board denied parole to Ronnie Wayne Whatley, 58, who is serving a 20-year sentence for attempted murder. He is currently held in the Elmore Correctional Facility and has served 15 years of his sentence.

Whatley was arrested in November 2009 for allegedly shooting a woman twice at an apartment in Butler County. His sentence for the conviction was handed down Dec. 12, 2011.

The board held 24 parole hearings that day, granting six and denying 18. The board also held 11 pardon hearings, granting five and denying six.
